We know that the entire bankruptcy process can be overwhelming and we're sure you have many questions about it. The following are some of the more frequently asked questions that we've heard from our clients. What's the first step?

The first step to filing a bankruptcy is to call us. From there, we can answer general questions and set up an initial consultation so that you can have a bankruptcy attorney assess your circumstances.

How long will the initial consultation take?

During the first consultation, you will begin by filling out a short questionnaire form. From there, you will meet with a bankruptcy attorney. During this meeting, the attorney will explain the relevant law, let you know about your options, and can assess whether a bankruptcy would be in your best interest. From start to finish, you should expect this to take approximately 30 - 60 minutes.

Is the initial consultation free?

Yes, it is absolutely free. If you don't wish to proceed with a bankruptcy after the consultation, then you don't have any further obligations to us.

What do I need to bring to a consultation?

You don't need to bring anything to an initial bankruptcy consultation. You just need to have a general idea of the debts that you owe and things that you own.

How much does a bankruptcy cost?

Bankruptcy fees will vary based on an individual client's circumstances and under which Chapter of bankruptcy he or she chooses to proceed. Fees will be determined during the initial consultation.

How soon can I file my case?

Deciding when to file will depend on various factors, but typically our office can put together everything within a couple days.

How long does a bankruptcy last?

This will depend on whether a Chapter 7 or a Chapter 13 is filed. Once a Chapter 7 is filed, you should expect your bankruptcy discharge within approximately four months. A Chapter 13 will last from 3 to 5 years. However, from the moment you file a bankruptcy, creditors must stop their collection attempts immediately.

Do you have payment plans?

Yes. We understand that if you're thinking about bankruptcy, then you may need some time to pay attorney fees. We will work with you the best that we can.

Do I have to go to court?

In all cases, you will have one meeting with a bankruptcy trustee that is assigned to your case. These meetings take place at court, but they are informal hearings that generally last about 10 minutes. In most cases, there is no need to appear in front of a judge.
